If you do not agree with these terms, please do not use this website, submit information, purchase tickets, register for events, or attend GardenWorks for Kids programs or events.

  1. TERMS OF USE

1.1 ABOUT GARDENWORKS FOR KIDS

GardenWorks for Kids is a children’s garden and outdoor learning space located in Yucaipa, California. We offer field trips, garden events, children’s programming, seasonal experiences, and related activities.

GardenWorks for Kids is not open for general public drop-in use unless a specific event, program, or open date is posted and ticketed.

All events, programs, field trips, and experiences are subject to availability, staffing, weather, safety considerations, and capacity limits.

1.2 USE OF THIS WEBSITE

You agree to use this website only for lawful purposes. You may not use this website to:

  • Submit false, misleading, or fraudulent information;

  • Interfere with the website’s security or functionality;

  • Attempt to access private systems, accounts, forms, data, or payment systems;

  • Copy, scrape, reproduce, or misuse our content, photos, branding, or materials;

  • Harass, threaten, or harm GardenWorks for Kids, its staff, volunteers, guests, partners, or families;

  • Use this website in any way that violates applicable federal, state, or local law.

We reserve the right to restrict or block access to this website or our services if we believe a person is violating these terms, creating a safety concern, abusing our systems, or acting in a way that harms GardenWorks for Kids or its community.

1.3 WEBSITE CONTENT

The content on this website is provided for general informational and promotional purposes. We try to keep event information, pricing, dates, and descriptions accurate, but we do not guarantee that all information will always be complete, current, or error-free.

We reserve the right to correct errors, update information, change pricing, modify event details, cancel events, reschedule events, or discontinue offerings at any time.

1.4 INTELLECTUAL PROPERTY

All content on this website, including but not limited to text, photographs, videos, graphics, logos, branding, event names, program descriptions, design elements, and written materials, is owned by or licensed to GardenWorks for Kids unless otherwise stated.

You may not copy, reproduce, distribute, modify, publish, sell, or use our content for commercial purposes without written permission from GardenWorks for Kids.

You may share public event pages or social media posts for personal, non-commercial purposes as long as you do not alter the content or falsely imply partnership, ownership, or endorsement.

1.5 TICKETS, REGISTRATIONS, AND PAYMENTS

Some events, programs, and field trips require advance registration and payment. Ticket availability is limited and may sell out.

Purchasing a ticket or submitting a registration does not guarantee participation if:

  • The event is canceled or rescheduled;

  • The participant does not meet age, safety, or program requirements;

  • Required forms, waivers, or payments are incomplete;

  • The attendee violates safety rules or event policies;

  • Attendance would create a safety, staffing, or capacity issue.

Payments may be processed through third-party platforms such as Eventbrite, Stripe, Square, PayPal, Venmo, Squarespace, or other payment processors. GardenWorks for Kids does not control the privacy or security practices of those third-party platforms. Your use of those platforms may be subject to their own terms and privacy policies.

1.6 REFUND, CANCELLATION, AND RESCHEDULE POLICY

Unless otherwise stated on a specific event page, all ticket sales are final.

Because GardenWorks for Kids is a small organization with limited capacity, staffing costs, supply costs, and event preparation expenses, we generally do not offer refunds for:

  • No-shows;

  • Illness;

  • Schedule changes;

  • Late arrivals;

  • Weather discomfort;

  • Child refusal to participate;

  • Parent or guardian change of plans;

  • Failure to read event details before purchasing;

  • Failure to meet age or participation requirements.

GardenWorks for Kids may, at its sole discretion, offer a credit, transfer, or reschedule option when possible, but we are not required to do so unless specifically stated in writing.

If GardenWorks for Kids cancels an event, we may offer a rescheduled date, credit, or refund depending on the circumstances.

If an event must be changed, delayed, shortened, moved, or rescheduled due to weather, safety concerns, staffing, vendor availability, illness, emergency, property conditions, or other circumstances beyond our control, we will make reasonable efforts to communicate updates using the contact information provided at registration.

1.7 WEATHER AND OUTDOOR CONDITIONS

GardenWorks for Kids is an outdoor garden environment. Events may involve sun, heat, wind, dirt, mud, water play, insects, uneven ground, plants, animals, tools, crafts, and other normal outdoor conditions.

By registering for or attending an event, you acknowledge that outdoor conditions may vary and that you are responsible for dressing yourself and your child appropriately.

GardenWorks for Kids may modify, pause, reschedule, or cancel activities due to weather, safety, or property conditions.

1.8 CHILDREN AND SUPERVISION

Parents, guardians, teachers, or approved adults are responsible for supervising children unless a specific program is clearly designated as a drop-off event.

For parent-stay events, the attending adult must remain on-site and actively supervise the child or children in their care.

For drop-off events, parents or guardians must provide accurate emergency contact information and must be reachable during the event. GardenWorks for Kids reserves the right to require parent/guardian support or deny drop-off participation if we determine that a child’s needs exceed the staffing, safety, or supervision capacity of the program.

Children may not be left unattended unless the event is expressly designated as a drop-off program and all registration requirements have been completed.

1.9 FIELD TRIPS AND GROUP VISITS

Field trips and group visits may have separate booking requirements, payment deadlines, chaperone policies, cancellation terms, safety rules, and participation guidelines.

Teachers, schools, organizations, and group leaders are responsible for communicating GardenWorks for Kids policies to parents, guardians, students, staff, and chaperones.

GardenWorks for Kids reserves the right to refuse or cancel a field trip or group visit if payment is not received, required information is incomplete, the group exceeds approved capacity, or safety requirements are not met.

1.10 ASSUMPTION OF RISK AND RELEASE OF LIABILITY

By attending GardenWorks for Kids, you understand and agree that participation in outdoor children’s activities involves inherent risks.

These risks may include, but are not limited to:

  • Trips, slips, and falls;

  • Contact with dirt, mud, water, plants, flowers, insects, or animals;

  • Sun exposure, heat, wind, or weather-related discomfort;

  • Allergic reactions;

  • Minor cuts, scrapes, bruises, or splinters;

  • Use of art supplies, gardening materials, sensory materials, tools, play structures, or activity stations;

  • Interaction with other children, families, staff, vendors, volunteers, or guests;

  • Risks associated with outdoor play and child-led exploration.

By registering for, purchasing tickets to, or attending an event, you voluntarily assume all risks associated with participation.

To the fullest extent permitted by California law, you agree to release, waive, discharge, and hold harmless GardenWorks for Kids, its directors, officers, employees, volunteers, contractors, vendors, representatives, property owners, partners, and affiliates from claims, damages, injuries, losses, liabilities, costs, or expenses arising out of or related to your participation or your child’s participation in GardenWorks for Kids activities, except where prohibited by law.

Nothing in these terms is intended to waive rights that cannot legally be waived under California law.

1.11 MEDICAL EMERGENCIES

In the event of an emergency, GardenWorks for Kids may contact emergency services and/or the emergency contact provided at registration.

By attending or registering a child for an event, you authorize GardenWorks for Kids staff or representatives to seek emergency medical care if reasonably necessary and if a parent, guardian, or emergency contact cannot be reached in time.

You are responsible for any medical costs, ambulance costs, or emergency care expenses resulting from your or your child’s participation.

Parents and guardians are responsible for disclosing relevant allergies, medical conditions, special needs, behavioral concerns, or safety considerations before participation.

1.12 ALLERGIES AND SPECIAL NEEDS

GardenWorks for Kids may include activities involving plants, soil, flowers, food, animals, insects, water, art supplies, sensory materials, or other potential allergens.

We cannot guarantee an allergen-free environment.

Parents, guardians, teachers, and group leaders are responsible for notifying GardenWorks for Kids in advance of any allergies, medical needs, sensory needs, behavioral needs, mobility needs, or other information necessary to support safe participation.

GardenWorks for Kids will make reasonable efforts to accommodate participants when possible but cannot guarantee that every need can be met in every program or event.

1.13 CONDUCT AND SAFETY RULES

GardenWorks for Kids is a family-friendly environment. We reserve the right to remove or refuse service to any person whose behavior is unsafe, disruptive, aggressive, threatening, disrespectful, intoxicated, inappropriate, or harmful to children, staff, guests, volunteers, property, animals, plants, or the overall environment.

No refunds will be issued if a person is removed or denied participation due to violation of safety rules, event policies, or inappropriate conduct.

1.14 PHOTOGRAPHY AND VIDEO NOTICE

GardenWorks for Kids may take photographs and videos during events, field trips, programs, and activities for marketing, social media, website, fundraising, grant reporting, educational, promotional, and archival purposes.

By attending a public or ticketed GardenWorks for Kids event, you acknowledge that you or your child may appear in photos or videos captured during the event.

If you do not want yourself or your child photographed or filmed, you must notify GardenWorks for Kids in writing before the event and also alert staff upon arrival.

For school field trips, schools, teachers, or group leaders are responsible for communicating any student media restrictions to GardenWorks for Kids in writing before the field trip.

GardenWorks for Kids will make reasonable efforts to honor photo/video opt-out requests but cannot guarantee that individuals will never appear incidentally in background images, crowd scenes, or public event documentation.

This includes, but is not limited to, loss of data, lost profits, lost opportunities, personal inconvenience, emotional distress, property damage, personal injury, or other claims, except where liability cannot legally be limited under California law.

You agree to defend, indemnify, and hold harmless GardenWorks for Kids, its directors, officers, employees, volunteers, contractors, vendors, representatives, partners, affiliates, and property owners from any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorney’s fees, arising from:
